DIRECTIONS NOTICE 

 

WHEREAS the Appellant, through its solicitors, filed an appeal on 10 May 2017 against a decision of the Respondent dated 31 March 2017, received by the Appellant on 3 May 2017, (‘the Decision’) together with an application for a direction pursuant to Rule 3 of the Charity Tribunal Rules (Northern Ireland) 2010 to stay these proceedings pending a decision by the Respondent on a request from the Appellant that it review the Decision;

 

AND WHEREAS the Respondent wrote to the Appellant’s solicitors on 9 May 2017 consenting to such application for a direction;

 

AND WHEREAS the Tribunal issued a Directions Notice on 15 May 2017 staying this appeal pending a review of its decision by the Respondent;

 

AND WHEREAS the Respondent wrote to the Appellant’s solicitors on 19 June 2017 to advise that it had reviewed is decision and would now proceed to enter the Appellant on the Register of Charities;

 

AND WHERAS no application was subsequently made by the Appellant’s solicitors either to request that the appeal be continued or to withdraw appeal, as directed by the Tribunal, no application to vary that Direction having been made by either party;

 

IT IS HEREBY DIRECTED AND ORDERED that

 

1.      Subject to paragraph 2 the Tribunal intends to formally dismiss this appeal at the expiration of 14 days from the date of this Notice for non-compliance by the Appellant with the said direction of the Tribunal pursuant to Rule 6 of the Charity Tribunal Rules (Northern Ireland) 2010.

 

2.      The Appellant may make representations, in writing, should it wish to do so, before the expiry of the said 14 days against the taking of the intended step.
