DECISION

The decision of the tribunal is that the capital value of the hereditament
situated at 531 Belfast Road, Bangor BT19 1IU is £390,000 and the tribunal Orders that the valuation list shall be altered accordingly.


REASONS

Introduction

1. The appellant appealed under Article 54 of the Rates (Northern Ireland) Order 1977 (“the 1977 Order”), as amended by the Rates (Amendment) (Northern Ireland) Order 2006 (“the 2006 Order”) against the decision of the Commissioner of Valuation for Northern Ireland (“the Commissioner”) on appeal dated 22ND July 2008 in respect of the valuation in the valuation list of a hereditament (“the hereditament”) situated at 531 Belfast Road, Bangor BT19 1IU.

2. After discussions, the parties have now agreed in writing the valuation of the hereditament at a capital value of £390.000.


THE TRIBUNAL’S DECISION AND ORDER


3. The parties having agreed in writing upon the terms of a decision in accordance with Rule 19 (1) of the Valuation Tribunal Rules (Northern Ireland) 2007 (“the 2007 Rules”), the tribunal thinks fit to make a decision and consequential Order in accordance with Rule 19 (4) of the 2007 Rules.


4. In consequence of the foregoing, the tribunal determines that under Article 39 and Schedule 12 of the 1977 Order, as amended by Article 8 of the 2006 Order, and Rule 19 (1) of the 2007 Rules, the capital value of the hereditament in the valuation list maintained by the Commissioner under Article 40 of the 1977 Order, as amended by Article 11 of the 2006 Order, is £390,000. Under Rule 19 (4) and Rule 19 (5) of the 2007 Rules the tribunal Orders that the valuation list shall be altered accordingly.
