2004 NO. 2

 

ORDERS FOR POSSESSION

 

1.      Where the Enforcement of Judgments Office has issued an Order for the delivery of possession of land pursuant to Article 53(1) of the Judgments Enforcement Order 1981 and the creditor instructs the Office to execute the Order under Article 53(2), the Office may apply to the Master for the dismissal of the Application for Enforcement if the creditor instructs EJO not to proceed with eviction when the following criteria have been met:

 

a)      A date for eviction has been confirmed with the creditor

b)      Contractors, whether internal or external, have been assigned to assist in the execution of the Order, at a financial cost to EJO

c)      The creditor refuses or neglects to withdraw their Application for Enforcement

 

 

2.      If an Application for Enforcement of a Possession Order is dismissed or withdrawn under the terms in 1) above, the creditor shall apply to the Master for leave to make a fresh Application for Enforcement using the same Order, if it is their wish so to do.

 

 

3.      These arrangements will take effect from 1 September 2004.
