ACTIONS BEGUN BY ORIGINATING SUMMONS
1. This direction, which replaces and revokes Practice Direction 1990 No1, is mainly concerned with the listing of actions begun by originating summons.
2. The following actions will be listed pursuant to notice of appointment [Form 10 Appendix A] or originating summons [Form 7] before the Judge: -
(a) actions in respect of any of the matters identified in Order 32 r11 as being outside a Master’s jurisdiction;
(b) actions brought under the Solicitors (Northern Ireland) Order 1976;
(c) actions under the Inheritance (Provisions for Family and Dependants) (Northern Ireland) Order 1979.
3. Except where otherwise directed by the Judge or the Master in any particular case, all
other actions begun by originating summons shall be listed before the Master.
4. When an originating summons [Form 7 Appendix A] under the Inheritance (Provision
for Family and Dependants) (Northern Ireland) Order 1979 is being issued in the Chancery Office the Plaintiff shall lodge at the same time the grounding affidavit, a copy of the grant of probate and will, or letters of administration, and a certificate from the Plaintiff’s solicitor stating that in his opinion the action does not fall within the jurisdiction of the County Court.
