APPEALS FROM MASTER TO JUDGE

IN CHAMBERS UNDER O 58 R 1

APPEAL BOOK

1.      Where a notice of appeal is issued pursuant to O 58 r 1 the solicitor for the appellant must lodge in the Chancery Office not later than 2 clear working days before the date fixed for the hearing of the appeal one appeal book of documents properly bound indexed and paginated for the use of the Judge containing the following copy documents:

(1)        notice of appeal;

(2)               summons issued before Master;

(3)               affidavits with exhibits;

(4)               order of Master appealed from.

  1. If the appeal book is not lodged in due time the appeal will not be listed for hearing until the book has been lodged other than on the application of a respondent claiming to be prejudiced by the failure of the solicitor for the appellant to do so.
  2. This direction replaces and revokes Practice Direction 1991 No 1.
