24 Nov 2011Ancillary Relief Pre-Application ProtocolThis protocol is intended to apply to all claims for ancillary relief as defined by Rule 1.3 of the Family Proceedings Rules (NI) 1996. It is designed to cover all classes of case, ranging from a simple application for periodical payments to an application for a substantial lump sum and property adjustment order. 02 Nov 2011Practice Note 1 of 2011The following Notes contain the main rules governing the listing of business before, and the hearing of summonses by, the masters in the Queen’s Bench Division of the High Court of Judicature. These Notes replace previous Practice Notes issued by the masters including: Practice Note No.1 of 2001, Adjournments in the Queens Bench Summons Courts; Practice Note No.2 of 2001, Proceedings by way of Summons before the Masters; Practice Note No.1 of 2002, Listing and Hearing of Assessments of Damages under Order 37; and Practice Note No.2 of 2002, Proceedings by way of Summons before the Masters. 30 Aug 2011Revised Protocol on Possession ProceedingsThis protocol describes the behaviour the court will normally expect of the parties prior to the start of a possession claim brought under the Rules of the Supreme Court Order 88 or the County Court Rules (NI) 1981 in relation to arrears on all residential mortgages including both those regulated by the Financial Services Authority under the Financial Services and Markets Act 2000 and those which are unregulated and agreements under the Consumer Credit Act 1974 secured by mortgage. It does not apply to proceedings brought in relation to what are commonly known as "buy to let" mortgages.
