17 Jun 2008 The Magistrates' Courts (Criminal Justice (Children)) (Amendment) Rules (Northern Ireland) 2008 These Rules amend the Magistrates' Courts (Criminal Justice (Children)) Rules (Northern Ireland) 1999 in consequence of the Criminal Justice (Northern Ireland) Order 2008 to: - amend Form 3 (Warrant for arrest of child) to show that the execution of the warrant may be proved in County Court Divisions other than the one in which it was issued, in accordance with Article 92 of the 2008 Order; and insert a new form of warrant to be used where a court passes an indeterminate or extended custodial sentence on a child under Article 13 or 14 of the 2008 Order.

29 Jun 2006 The Planning (National Security Directions and Appointed Representatives) (Amendment) Rules (Northern Ireland) 2006 SR 2006 no 285 These Rules amend the definition of electronic communication in the Planning (National Security Directions and Appointed Representatives) Rules (Northern Ireland) 2006 to accord with the current definition provided by section 4(1) of the Electronic Communications Act (Northern Ireland) 2001, as amended by the Communications Act 2003. The Rules shall come into operation on 24th July 2006.

20 Jun 2006 Draft Family Proceedings (Amendment) Rules (Northern Ireland) 2006 These Rules amend the Family Proceedings Rules (Northern Ireland) 1996 (S.R. 1996 No. 322) and remove the requirement to lodge a bundle of pleadings in undefended causes and make minor amendments consequential to the Constitutional Reform Act 2005. Where there is an application for ancillary relief which includes an application for a pension sharing order or a pension attachment order, the Rules provide for information to be given to the other party by the party with pension rights in certain circumstances.

12 Dec 2005 Rules of the Supreme Court (NI) (Amdt) 2006 These Rules amend Order 123 of the Rules of the Supreme Court (Northern Ireland) 1980 so as to prescribe the practice and procedure to be used in the High Court in relation to applications for property freezing orders under sections 245A to 245D of the Proceeds of Crime Act 2002 (the 2002 Act); exclusions from property freezing orders and interim receiving orders to enable a person to meet his reasonable legal expenses in respect of those civil recovery proceedings; and applications under Part 5 of the Proceeds of Crime Act 2002 (External Requests and Orders) Order 2005 (the Order in Council), which makes provision for giving effect in the United Kingdom to external orders by means of civil recovery.
12 Dec 2005 The Criminal Appeal (Prosecution Appeals) (Amendment) Rules (Northern Ireland) 2006 These Rules amend the Criminal Appeal (Prosecution Appeals) Rules (Northern Ireland) 2005 to prescribe those applications which may be heard by a single judge of the Court of Appeal; and to provide that where a single judge of the Court has refused an application, the party may renew the application to the full Court.
12 Dec 2005 The Criminal Appeal (Retrial for Serious Offences) (Amendment) Rules (Northern Ireland) 2006 These Rules amend the Criminal Appeal (Retrial for Serious Offences) Rules (Northern Ireland) 2005 to prescribe those applications which may be heard by the proper officer; to prescribe those applications which may be heard by a single Judge of the Court of Appeal; and to provide that where the proper officer or, as the case may be, a single judge of the Court has refused an application, the party may renew the application to a single judge of the Court of Appeal or, as the case may be, the full Court.
09 Dec 2005 The Family Proceedings (Amendment No. 3) Rules (Northern Ireland) 2005 These Rules amend the Family Proceedings Rules (Northern Ireland) 1996 (S.R. 1996 No. 322), which apply to proceedings in the High Court and county courts, to extend the rules in respect of the procedure for recognition of a judgment under Council Regulation (EC) 2201/2003 to apply equally to a judgment pronounced by a court in a Member State to which the Civil Partnership (Jurisdiction and Recognition of Judgments) Regulations 2005 (S.I. 2005/3334) applies.
08 Dec 2005 Magistrates' Court (Misc Amdt) Rules 2005 These Rules make amendments to two sets of rules, which apply in proceedings in magistrates' courts, in consequence of the Civil Partnership Act 2004 (c.33). The Civil Partnership Act 2004 introduces a statutory civil registration procedure to allow same-sex couples to make a formal, legal commitment to each other by entering into a civil partnership. The Rules amend the Magistrates' Courts (Domestic Proceedings) Rules (Northern Ireland) 1996 to prescribe the procedures for proceedings under Schedule 16 to the 2004 Act. They also make minor consequential amendments to forms prescribed in the Magistrates Courts (Children (Northern Ireland) Order 1995) Rules (Northern Ireland) 1996.

29 Jun 2005 Rules of the Supreme Court (Northern Ireland) (Amendment No. 4) 2005 These Rules amend the Rules of the Supreme Court (Northern Ireland) 1980 ('the principal rules' to prescribe the procedure relating to applications for control orders under the Prevention of Terrorism Act 2005. These Rules replace the Rules of the Supreme Court (Northern Ireland) (Amendment No. 3) 2005 (S.R. 2005 No. 191) and are made under exercise of the power in paragraph 3(6) of the 2005 Act.

27 Apr 2005 Pensions Appeal Commissioners (Procedure)(Northern Ireland) Regulations 2005 These Regulations prescribe the procedure of the Social Security Commissioners for Northern Ireland (to be known as Pensions Appeal Commissioners) in determining appeals and applications arising from decision of the Pensions Appeal Tribunal under the Pensions Appeal Tribunals Act 1943, as amended by the Armed Forces (Pension and Compensation) Act 2004.

27 Apr 2005 Criminal Appeal (Prosecution Appeals) Rules (Northern Ireland) 2005 These Rules prescribe the procedures which apply in the Court of Appeal in relation to prosecution appeals under Article 17 of the Criminal Justice (Northern Ireland) Order 2004. Article 17 of the 2004 Order provides for a prosecution right of appeal to the Court of Appeal against rulings by a judge of the Crown Court, made at any time (whether before or after the commencement of the trial) before the judge starts his summing-up to the jury, that have the effect of terminating the trial.

27 Apr 2005 Social Security Commissioners (Procedure) (Child Trust Funds) Regulations (Northern Ireland) 2005 These Regulations regulate the procedure of the Social Security Commissioners for Northern Ireland in determining appeals and applications arising from decisions of appeal tribunals in relation to child trust funds. The Child Trust Funds (Non-tax Appeals) Regulations 2005 (S.I. 2005/191) are made under section 24(5) of the Child Trust Funds Act 2004 (c.6) and apply and modify provisions in the Social Security (Northern Ireland) Order 1998 (SI 1998/1506 (NI 10) to provide for a temporary route of appeal in respect of Child Trust Funds. Appeals are heard initially by an appeal tribunal constituted under Chapter 1 of Part II of the Social Security (Northern Ireland) Order 1998, and a further right of appeal will exist to the Social Security Commissioners. These Regulations will apply until the Treasury makes an order under section 24(1) of the Child Trust Fund Act 2004.

12 Apr 2005 Draft Legal Aid (Scope) Regulations 2005 These Regulations amend Schedule I to the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981 to reflect the provision made by section 26(6) of the Asylum and Immigration (Treatment of Claimants, etc.) Act 2004 which allows the High Court or Asylum and Immigration Tribunal power, in specific circumstances, to order that an appellant's costs shall be paid retrospectively out of the fund established under paragraph 4(2)(a) of Schedule 3 to the Access to Justice (Northern Ireland) Order 2003.

25 Nov 2004 Draft County Court Fees (Amendment No.2) Order (Northern Ireland) 2004 This Order amends the County Court Fees Order (Northern Ireland) 1996 to prescribe the fee to be taken in respect of applications to the court in relation to a bookmaking office licence under the Betting, Gaming, Lotteries and Amusements (Northern Ireland) Order 1985.
25 Nov 2004 Magistrates' Courts Fees (Amendment No.2) Order (Northern Ireland) 2004 This Order amends the Magistrates' Courts Fees Order (Northern Ireland) 1996 to prescribe the fee to be taken in respect of an application to vary or remove conditions in respect of a licence for an indoor arena under Article 77A of the Licensing (Northern Ireland) Order 1996; and delete the fees payable in respect of an application for the grant of a bookmaking office licence, an application for the provisional grant of a bookmaking office licence and an application to have provisional grant of a bookmaking office licence declared final.
03 Nov 2004 Draft Legal Aid for Crown Court Proceedings (Costs) Rules (Northern Ireland) 2004 These Rules prescribe the Crown Court remuneration for solicitors assigned under Articles 29 or 36(2) of the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981. Schedule 1 deals with the standard fees which shall be payable for most cases in the Crown Court. Initial determinations in such cases will be undertaken by the Northern Ireland Legal Services Commission. Schedule 2 provides for special hourly rates of payment in very high cost cases, in respect of which determinations will be undertaken by the taxing master. A system of redeterminations and appeals is provided enabling solicitors to challenge the fees determined in a particular case.
03 Nov 2004 Draft Criminal Aid Certificates Rules (Northern Ireland) 2005 These Rules are a consolidating instrument to replace the Legal Aid Certificates Rules (Northern Ireland) 1966, the Legal Aid (Defence Certificates) Rules (Northern Ireland) 1966 and the Legal Aid (Appeal Aid Certificates) Rules (Northern Ireland) 1966, which are revoked. The Rules prescribe the form of criminal aid certificates to be used when free legal aid is granted for work in the magistrates' court (under Articles 28(1) and 28A of the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981 Order), the Crown Court (under Article 29(2) of the Order) and for appeals heard in the County Court (under Article 30(3) of the Order). They also extend the definition of counsel for this purpose to include any solicitor who has been certified by the Law Society as being an Advanced Advocate.

22 Sep 2004 County Court (Amendment No 2 Part IV) (Northern Ireland) Rules 2004 These Rules are made in consequence of the Licensing (Indoor Arenas) (Northern Ireland) Order 2004 which amends the Licensing (Northern Ireland) Order 1996 to add an indoor arena to the types of premises for which a court may grant a licence for the retail sale of intoxicating liquor. The Rules amend Order 48 of the County Court Rules (Northern Ireland) 1981 to, in particular, insert a new Form 200A for use in applications for the grant or provisional grant of a licence for an indoor arena.
22 Sep 2004 County Court (Amendment No 2 Part II) (Northern Ireland) Rules 2004 These Rules amend Order 32 of the County Court Rules (Northern Ireland) 1981 (the principal Rules) and contain provision relating to the service of United Kingdom processes abroad under the Crime (International Co-operation) Act 2003 (the Act). Rule 2 inserts new Rules 6NE-6NG into Part IIA of Order 32 of the principal Rules. New Rule 6NE provides an interpretation of certain terms used in the new Rules. New Rule 6NF prescribes the information that shall be contained within the notice required by section 3(4) of the Act to accompany process served outside the United Kingdom. New Rule 6NG provides that service of a process under section 4 of the Act may be proved by a certificate given by or on behalf of the Secretary of State, which shall be admissible as evidence of any facts stated therein.

15 Sep 2004 Magistrates' Courts (Licensing) (Amendment) Rules (Northern Ireland) 2004 These Rules are made in consequence of the Licensing (Indoor Arenas) (Northern Ireland) Order 2004 which amends the Licensing (Northern Ireland) Order 1996 to: add an indoor arena to the types of premises for which a court may grant a licence for the retail sale of intoxicating liquor; and provide for a new type of application to a court of summary jurisdiction to attach, vary or remove conditions in respect of a licence for an indoor arena during its currency. The Rules amend the Magistrates Courts (Licensing) Rules (Northern Ireland) 1997 to, in particular, prescribe the procedure for an application to attach, vary or remove conditions in respect of a licence for an indoor arena.
14 Sep 2004 The Legal Aid for Crown Court Advocacy (Costs) Rules (Northern Ireland) 2004 These Rules prescribe the Crown Court remuneration for counsel assigned under Article 29 of the Legal Aid, Advice and Assistance (Northern Ireland) Order 1981. The main body of the Rules deals with the manner in which costs are to be determined and paid. Those provisions draw to a large extent on the Legal Aid in Criminal Proceedings (Costs) Rules (Northern Ireland) 1992, which relate to criminal representation provided under Part III of the 1981 Order, and which are being superseded by these Rules insofar as they prescribe the remuneration payable for advocacy in the Crown Court

The consultation proposal was the result of the Northern Ireland Court Service's engagements with key stakeholders, specifically, the Law Society of Northern Ireland, the General Council of the Bar of Northern Ireland and the Northern Ireland Legal Services Commission.

The purpose of this consultation document is to seek views on the proposal to regulate the circumstances in which two counsel could be assigned to defendants being prosecuted at the Crown Court.
07 Sep 2009 Graduated Fee Schemes Consultation The purpose of this consultation is to obtain the views of consultees on the introduction of graduated fee schemes to replace the standard fee schemes in the 2005 Rules.
21 Aug 2009 Review of the Legal Aid for Crown Court Proceedings (Costs) Rules (Northern Ireland) 2005 The Legal Aid for Crown Court Proceedings (Costs) Rules (Northern Ireland) 2005 (the 2005 Rules) govern the remuneration of solicitors and advocates acting for legally aided defendants in criminal cases at the Crown Court in Northern Ireland. They do this by way of standard fees with the exception of cases certified by the Northern Ireland Legal Services Commission as being 'very high cost cases'. In these cases, solicitors and advocates are remunerated (mainly) by way of hourly rates. The review of this element of the 2005 Rules was carried out as a separate exercise by the Northern Ireland Court Service (the Court Service) in 2008. The Court Service, therefore, makes no comment on 'very high cost cases' as part of this review report. The purpose of this document is to set out the Court Service's conclusions arising from the review of the 2005 Rules.
06 Jul 2009 Summary Response on the Court Hearing Centre Consultation. A consultation paper "Proposals for Court Hearing Centres at Bangor, Larne, Limavady, Magherafelt and Strabane" was published on 12 January 2009. The period of consultation closed on 3 April 2009 and in total the Northern Ireland Court Service received 17 responses. In addition we held a public meeting at each of the proposed Hearing Centre venues. The Northern Ireland Court Service have carefully considered all responses and are satisfied that the Hearing Centres proposals strike an appropriate balance between the provision of quality services and ensuring that public money is used efficiently. Accordingly the Justice Minister Bridget Prentice MP has approved the establishment of Hearing Centres at the existing court venues in Bangor, Larne, Limavady, Magherafelt and Strabane.
03 Feb 2009 Summary of Responses to the Consultation Paper on Very High Cost Consultation This document is the post-consultation report for the consultation on Very High Cost Criminal Cases commenced on 30 June 2008. The Consultation Document invited comments on the introduction of contracts for the provision of defence services to defendants at the Crown Court between members of the legal profession and the Northern Ireland Legal Services Commission.
12 Jan 2009 Proposals for Court Hearing Centres at Bangor, Larne, Limavady, Magherafelt and Strabane This consultation paper seeks views on proposals to establish Hearing Centres at five existing court venues in Northern Ireland by 2009. Hearing Centres will only open on days when a court is sitting at the venue and, on those days, they will provide a full range of court office services.

24 Jul 2006 Consultation on Partial RIA in relation to Review of Northern Ireland County Court Scale Costs This is a Partial regulatory impact assessment (RIA) of the options under consideration in relation to the current review of county court scale costs in Northern Ireland. It is presently proposed to increase the scale costs by 10.47% in line with inflation for the period beginning of April 2002 to end of March 2006 as measured using the GDP deflator series. 10 Feb 2006 Draft Code of Practice on Judicial Complaints This consultation document has been issued by the Lord Chief Justice's Office. From April of this year, the Lord Chief Justice will be responsible for handling complaints made against members of the judiciary. This document sets out in draft form the proposed procedures for handling such complaints. We would welcome views on these proposals.

29 Nov 2007 HMICA Report on the inspection of the Coroners Service for Northern Ireland In April 2006, the Northern Ireland Court Service (NICtS) established the Coroners Service for Northern Ireland (CSNI). The Coroners' Service had been reformed both judicially and administratively and NICtS asked Her Majesty's Inspectorate of Court Administration (HMICA) to inspect the administrative function of CSNI to see if it was delivering an improved service to bereaved families.
