The Family Proceedings Rules Committee makes the following Rules in exercise of the powers conferred by Article 12 of the Family Law (Northern Ireland) Order 1993().

Citation and commencement

  1.  These Rules may be cited as the Family Proceedings (Amendment No. 2) Rules (Northern Ireland) 2008 and shall come into operation on 5th September 2008.

Amendment to the Family Proceedings Rules (Northern Ireland) 1996

  1.  The Family Proceedings Rules (Northern Ireland) 1996() shall be amended in accordance with rule 3 below.

  2.  In Part IVC, after rule 4C.8. insert—

“County courts prescribed as an authorised court

4C.9. For the purposes of Article 2(2)(c) a county court specified as a family care centre in Schedule 2 to the Children (Allocation of Proceedings) Order (Northern Ireland) 1996 is prescribed as an authorised court.”.

EXPLANATORY NOTE

(This note is not part of the Rules)

These Rules amend the Family Proceedings Rules (Northern Ireland) 1996 [S.R. 1996 No. 322], which apply to proceedings in the High Court and county courts, to prescribe a county court specified as a family care centre in Schedule 2 to the Children (Allocation of Proceedings) (Northern Ireland) Order 1996 [S.R. 1996 No. 300] as an authorised court for the purposes of Article 2(2)(c) of the Adoption (Northern Ireland) Order 1987 [S.I. 1987/2203 (N.I 22)].
