14 Dec 2011The Rules of the Court of Judicature (NI) (Amendment No.4) 2011 [S.R.2011 No.422]These Rules amend the Rules of the Court of Judicature (Northern Ireland) 1980 (“the principal Rules”) by— (a) amending Order 1 rule 2, so that it is subject to Order 116C rule 2; (b) inserting a new Order 116C containing rules about proceedings under the Terrorism Prevention and Investigation Measures Act 2011 (“the Act”) (including the modification of the application of certain other Parts of the Principal Rules for the purposes of those proceedings);and (c) inserting new Form 37C to be used in appeal under section 16 of the Act. The Act provides for the imposition of measures by way of a TPIM notice on individuals the Secretary of State reasonably believes to be, or to have been, involved in terrorism-related activity. Made by the Lord Chancellor on the 14th December 2011. 09 Dec 2011Criminal Appeal (Prosecution Appeals) (Banning Orders) Rules (Northern Ireland) 2011 [S.R.2011 No.419]These Rules prescribe the procedures which apply in the Court of Appeal in relation to prosecution appeals under section 43 of the Justice Act (Northern Ireland) 2011 (“the 2011 Act”). Section 43 of the 2011 Act provides for a prosecution right of appeal to the Court of Appeal against the failure by a judge of the Crown Court to make a banning order under section 41 of the 2011 Act. A banning order, made on conviction, prohibits a person from entering any premises for the purpose of attending regulated matches.Made by the Court of Judicature Rules Committee on 9 December 2011 and allowed by the Minister of Justice on that date. 09 Dec 2011The County Court (Amendment No.3) Rules (NI) 2011 [S.R.2011 No.421]These Rules make a number of amendments the County Court Rules (Northern Ireland) 1981 (S.R 1981 No.225) which take account of the amendments made to Article 9 of the Criminal Evidence (Northern Ireland) Order 1999 (‘special measures relating to child witnesses’) by the Justice Act (Northern Ireland) 2011.Made by the County Court Rules Committee on 9 December 2011 and allowed by the Minister of Justice on that date. 09 Dec 2011The Magistrates’ Courts (Amendment No.2) Rules (Northern Ireland) 2011 [S.R.2011 No.418] These Rules make a number of amendments to the Magistrates’ Courts Rules (Northern Ireland) 1984 (S.R. 1984 No.225) to allow for: • domestic and overseas freezing order applications under the Crime (International Co-operation) Act 2003 (“the 2003 Act”) to be made to the magistrates’ courts; • the procedure to be followed when making an application to a magistrates’ court for a third party witness summons, in criminal proceedings, under new Articles 118A-118E of the Magistrates’ Courts (Northern Ireland) Order 1981 (as inserted by the Justice Act (Northern Ireland) 2011 (“the 2011 Act”)); and • the amendments made to Article 9 of the Criminal Evidence (Northern Ireland) Order 1999 (“the 1999 Order”) (special provisions relating to child witnesses) by the 2011 Act. Made by the Magistrates’ Courts Rules Committee on 9 December 2011 after consultation with the Department of Justice and with the agreement of the Lord Chief Justice. A banning order, which may only be made on conviction, prohibits a person from entering any premises for the purpose of attending regulated matches.Made by the Magistrates’ Courts Rules Committee on 9 December 2011 after consultation with the Department of Justice and with the agreement of the Lord Chief Justice. 27 Jun 2011The Divorce and Dissolution etc. (Pension Protection Fund) Regulations (Northern Ireland) 2011 [SR 2011 No. 244]These Regulations make provision relating to orders under the Matrimonial Causes (Northern Ireland) Order 1978 Act (N.I.18) ("the 1978 Order") and the Civil Partnership Act 2004 (c.33) ("the 2004 Act"), including those made after proceedings overseas, made in connection with proceedings for divorce or dissolution of a civil partnership, nullity of marriage or nullity of a civil partnership or separation which relate to the pension compensation rights of a party to the marriage (described in section 27G(4) of the 1978 Order as the "party with compensation rights") or a party to a civil partnership (described in paragraph 32(1) of Schedule 15 to the 2004 Act as the "civil partner with compensation rights"). Made on 27th June 2011 by the Department of Justice. 21 Jun 2011The Crown Court (Amendment) Rules (NI) 2011 (SR 2011 No. 230) These Rules amend the Crown Court Rules (Northern Ireland) 1979 to prescribe the procedure for making an application to the Crown Court under the Crime (International Co-Operation) Act 2003 Act to allow for the mutual recognition, between EU States, of an order freezing evidence in criminal proceedings. 25 Mar 2010The Charity Tribunal Rules (Northern Ireland) 2010 (SR 2010 No. 77) The Charity Tribunal Rules (Northern Ireland) 2010 (the Rules) regulate the practice and procedure of proceedings before the Charity Tribunal for Northern Ireland (the Tribunal) established by section 12 of the Charities Act (Northern Ireland) 2008 (the Act). The Tribunal has jurisdiction to hear appeals and applications for review from certain decisions of the Charity Commission for Northern Ireland (the Commission) and to consider matters referred to it by the Attorney General or, with the Attorney Generals consent, the Commission (a reference being made before the Tribunal has made any decision in relation to the proceedings in which the question being referred has arisen). 25 Mar 2010The Rules of the Court of Judicature (NI) (Amendment) 2010 (SR 2010 No. 49) These Rules amend the Rules of the Court of Judicature (Northern Ireland) 1980 [S.R. 1980 No. 346] to:- assign to the Family Division of the High Court proceedings under Article 32L of the Child Support (Northern Ireland) Order 1991 and proceedings under the Hague Convention of 19th October 1996;- prescribe the procedure for appeals from Industrial Tribunals and the Fair Employment Tribunal to the Court of Appeal;- prescribe the procedure for an application under section 62 of the Crime (International Co-operation) Act 2003 to the Court of Appeal to suspend a foreign driving licence disqualification;- prescribe certain procedures under the Defamation Act 1996; and- make savings provisions in relation to certain defamation actions and appeals from Industrial Tribunals and the Fair Employment Tribunal.MADE - by the Northern Ireland Court of Judicature Rules Committee, and allowed by the Lord Chancellor. 25 Mar 2010The Valuation Tribunal (Amendment) Rules (Northern Ireland) 2010 (SR 2010 No. 104)The Valuation Tribunal Rules (Northern Ireland) 2007 [S.R. 2007 No. 182 as amended by S.R. 2008 No. 153] (the principal Rules) regulate the exercise of rights of appeal to the Northern Ireland Valuation Tribunal (the Tribunal) and prescribe the practice and procedure in relation to proceedings before the Tribunal.These Rules amend the principal Rules in consequence of the introduction of a right of appeal to the Tribunal against the result of a review by the Department of Finance and Personnel of- a decision made by it in relation to an application for a rate reduction under the Rate Relief (Energy Efficiency Homes Scheme) Regulations (Northern Ireland) 2010 (S.R. 2010 No. 67); or- a decision made by it in relation to an application for rate relief under the Rate Relief (Low-Carbon Homes Scheme) Regulations (Northern Ireland) 2010 (S.R. 2010 No. 66). 28 Jan 2010The Magistrates Courts (Amendment) Rules (Northern Ireland) 2010 - 2010 No. 12 These Rules make a number of amendments to the Magistrates Courts Rules (Northern Ireland) 1984 (the principal Rules)a. to prescribe the procedure to be followed in respect of -  - an application for the transmission of evidence between EU Member States in criminal proceedings; - an appeal against the recognition in the UK of a foreign driving disqualification; and- the recognition in the UK of a financial penalty issued in another EU Member State; andb. 28 Jan 2010The Magistrates Courts (Anti-Social Behaviour Orders) (Amendment) Rules (Northern Ireland) 2010 - 2010 No. 16The Rules amend the Magistrates Courts (Anti-Social Behaviour Orders) Rules (Northern Ireland) 2004 to remove an erroneous reference in the Note to Form 1 which advises the defendant that if he fails to attend court in answer to the summons, a warrant will be issued for his arrest. As ASBOs are civil orders, no power of arrest is available to the magistrates court in respect of the non-appearance of a defendant. 28 Jan 2010The Magistrates Courts (Detention and Forfeiture of Seized Cash) (Amendment) Rules (Northern Ireland) 2010 - 2010 No. 14 The Policing and Crime Act 2009 (the 2009 Act) inserts new sections into the Proceeds of Crime Act 2002 which allow senior officers to forfeit detained cash without a court order. The Rules amend the Magistrates Courts (Detention and Forfeiture of Seized Cash) Rules (Northern Ireland) 2003 to prescribe the procedure to be followed on an application to set aside such a forfeiture. The 2009 Act also increases the maximum period for which a court may authorise the detention of cash from 3 months to 6 months, and the draft Rules amend  the 2003 Rules to reflect this change. 28 Jan 2010The Magistrates Courts (Sexual Offences Act 2003) (Amendment) Rules (Northern Ireland) 2010 - 2010 No. 15 The 2009 Act makes a number of amendments to the Sexual Offences Act 2003 in relation to foreign travel restriction orders. In particular, the maximum duration of an order is extended from 6 months to 5 years and offenders subject to an order prohibiting travel outside the UK will be required to surrender their passports. 15 Dec 2009The Court of Judicature Fees (Amendment) Order Northern Ireland 2009This Order amends Section 5 (Fees Payable in the Taxing Office) of the Court of Judicature Fees Order (Northern Ireland) 1996 [S.R. 1996 No. 100] so as to       (i)            restrict the fee of 5% of the original bill submitted for taxation to a maximum fee of 3,500;      (ii)            restrict the fee of 0.15 for every 1 or fraction of 1 on the amount allowed on taxation to a maximum fee of 10,500; and    (iii)            correct some minor typographical errors.The Supreme Court Fees Order (Northern Ireland) 1996 has been renamed the Court of Judicature Fees Order (Northern Ireland) 1996 as a consequence of the renaming of the Supreme Court of Judicature of Northern Ireland by virtue of section 59 and paragraph 6 of Schedule 11 to the Constitutional Reform Act 2005 (c.4). 15 Dec 2009The Insolvency (Amendment) Rules Northern Ireland 2009These Rules amend the Insolvency Rules (Northern Ireland) 1991 (S.R. 1991 No. 364) (the principal Rules), of which there are two versions.The principal Rules as amended by the Insolvency (Amendment) Rules (Northern Ireland) 2006 (the 2006 Rules) apply to all insolvency proceedings other than special administration regimes. These are referred to in this note as the current principal Rules.However, rule 5 of the 2006 Rules provides that, in cases where Part III of the Insolvency (Northern Ireland) Order 1989 applies without amendments made by the Insolvency (Northern Ireland) Order 2005, the principal Rules continue to apply without the amendments made by the 2006 Rules.Article 4 of the Insolvency (Northern Ireland) Order 2005 provides for Part III of the Insolvency (Northern Ireland) Order 1989 to continue to apply as prior to amendment by the Insolvency (Northern Ireland) Order 2005 in two special administration regimes, namely(a)     licence companies within the meaning of section 26 of the Transport Act 2000 (c. 38) (air traffic services), or(b)     building societies within the meaning of section 119 of the Building Societies Act 1986 (c. 53) (interpretation).The version of the principal Rules applying to special administration regimes is referred to in this note as the former principal Rules.These Rules make amendments to both the current and former principal Rules consequent on the coming into force on 1 October 2009 of the Companies Act 2006. 25 Nov 2009The Defamation Act 1996 (Commencement No. 4) Order 2009This Order brings into force on 6th January 2010 all the provisions of the Defamation Act 1996 which apply in Northern Ireland and which have not so far been brought into force. This Order also contains a transitional provision in relation to section 4 of the Defamation Act (Northern Ireland) 1955. 01 Oct 2009The Rules of the Court of Judicature (Northern Ireland) (Amendment No. 4) 2009These Rules amend the Rules of the Court of Judicature (Northern Ireland) 1980 (S.R. 1980 No. 346) to: assign certain appeals from the Taxing Master to the Queens Bench Division; extend the time period allowed to serve a defence on the plaintiff and to specify matters which must be included in any defence; provide that the High Court may order a plaintiff to give security for the defendant's costs where the plaintiff is a company or other body and there is reason to believe that it will be unable to pay the defendant's costs if ordered to do so; and provide the practice and procedure for proceedings under the Presumption of Death Act (Northern Ireland) 2009.DRAFT - These Rules are currently being considered by the Court of Judicature Rules Committee and, if allowed by the Lord Chancellor, will come into operation in the main on 9 November 2009. 28 May 2009The Rules of the Supreme Court (Amendment No.2) (Northern Ireland) 2009These Rules amend the Rules of the Supreme Court (Northern Ireland) 1980 (SR 1980 No. 346) to correct an erroneous reference to the senior Lord Chief Justice; make provision for the disclosure of evidence in actions relating to clinical negligence; make provision for procedures under Regulation (EC) No 1896/2006 of the European Parliament and of the Council of 12 December 2006 creating a European order for payment procedure; provide that a judge hearing an action in the Chancery Division shall have the same powers as the Commercial Judge if the action has been entered in the Commercial list of the Queen's Bench; take account of amendments to the Consumer Credit Act 1974 made by the Consumer Credit Act 2006 in relation to applications for time orders in connection with credit agreements; remove references to the VAT and duties tribunal as a result of the transfer of functions of various tax tribunals to the First-tier Tribunal and Upper Tribunal established under the Tribunals, Courts and Enforcement Act 2007 ("the 2007 Act") and the Transfer of Tribunal Functions and Revenue and Customs Appeal Order 2009 (S.I. 2009/56) ("the 2009 Order"); make consequential amendments, insert references to the Inheritance Tax Act 1984 and reflect minor changes to procedure for appeals in revenue proceedings to the High Court as a result of the 2009 Order; remove references to the VAT and duties tribunal and to provide for a right of appeal from the Upper Tribunal to the Court of Appeal under section 13 of the 2007 Act; and make savings provisions in relation to the application of those rules amended as a result of the 2007 Act and the 2009 Order.These Rules were considered and made by the Supreme Court Rules Committee on 26th May 2009. 11 May 2009The Criminal Appeal (Amendment) (Northern Ireland) Rules 2009These Rules amend the Criminal Appeal (Northern Ireland) Rules 1968 (S.R. 1968 No.218) ("the principal Rules") to take account of Part III of the Criminal Justice (Northern Ireland) Order 2004 ("the 2004 Order"), and Article 83 of the Criminal Justice (Northern Ireland) Order 2008 ("the 2008 Order"). Part III of the 2004 Order provides for witnesses other than the defendant to give evidence in specified criminal proceedings through a live link. 11 May 2009The Criminal Appeal (Serious Crime Prevention) Rules (Northern Ireland) 2009 These Rules make provision for applications to the Court of Appeal in relation to appeals under section 24 of the Serious Crime Act 2007 ("the 2007 Act") and Parts 5 and 6 of the Serious Crime Act 2007 (Appeals under section 24) Order 2008 ("the 2008 Order"). Section 24 of the 2007 Act provides that a person who is the subject of a serious crime prevention order, or the Director of Public Prosecutions may appeal to the Court of Appeal against a decision of the Crown Court in relation to that order. In addition, any person who was given an opportunity to make representations in the proceedings by virtue of section 9(4) of the 2007 Act may appeal to the Court of Appeal against a decision of the Crown Court to make, vary or not vary a serious crime prevention order. 16 Jan 2009The Rules of the Supreme Court (Northern Ireland) (Amendment No. 3) 2008These Rules amend the Rules of the Supreme Court (Northern Ireland) 1980 (the principal Rules) by (a) amending Order 1 rule 1A(4) so that it is subject to both Order 116A and 116B; (b) inserting a new Order 116B containing rules about financial restrictions proceedings under the Counter-Terrorism Act 2008; and (c) modifying the application of certain other Orders in the principal Rules for the purposes of those proceedings. The Counter-Terrorism Act 2008 provides for financial restrictions proceedings, including the application to the High Court to set aside a financial restrictions decision. The new Order 116B inserted into the principal Rules by these Rules sets out the procedure for such applications to the High Court and any appeal to the Court of Appeal. These Rules have been made by the Lord Chancellor and laid before Parliament under section 72(4) of the Counter- Terrorism Act 2008, for approval by resolution of each House of Parliament. 14 Dec 2006The Insolvent Partnerships (Amendment) Order (Northern Ireland) 2006The Insolvency (Northern Ireland) Order 1989 Order was amended by the Insolvency (Northern Ireland) Order 2005 (S.I. 2005/1455(N.I.10))(the 2005 Order). The 2005 Order effects changes to the law applying to the insolvency of individuals and companies. The main changes include: the setting of a threshold value below which it will not be possible for a trustee to claim a bankrupts equity in his dwelling house; restoration to the ownership of the bankrupt of his equity in his dwelling house if the equity is not dealt with by his trustee within three years from the date of his bankruptcy; insertion of a replacement Part III and new schedule B1 into the 1989 Order creating an enhanced administration procedure designed to facilitate company rescue. The Insolvent Partnerships Order (Northern Ireland) 1995 needs to be amended to take account of the changes to the 1989 Order. The draft Amendment Order effects these amendments.
