03 Oct 2014Review of Fees Charged in the Lands Tribunal for Non-Domestic Rating Valuation AppealsThe civil courts in Northern Ireland currently operate under a policy where the full costs of running the civil courts are recovered from fees charged for providing the service. The fees charged are set in legislation and are based on recovering the administrative, judicial and other costs associated with the proceedings. In Northern Ireland few tribunals charge fees. The Lands Tribunal statutorily transferred to NICTS in April 2011 from the Department of Finance and Personnel (DFP). The Tribunal fees have not been reviewed since the body’s inception in 1964 and the present fee regime does not accurately reflect the costs associated with the appeals process. Proposals have been developed to increase the fees charged for non-domestic rating valuation appeals to ensure that the cost of providing such appeals is met by these users of the Tribunal. 22 Aug 2013Consultation on a Draft pre -Action Protocol for Ejectment Proceedings based on Non-payment of Rent in the Social Housing SectorLandlords in Northern Ireland may take ejectment proceedings in the County Court for non-payment of rent with the objective of obtaining a possession order. The Lord Chief Justice believes that, in cases taken by social housing landlords, it would be beneficial for all parties to be aware of the steps that the court will expect parties to have taken before initiating court proceedings and up to the date of hearing. A draft pre-action protocol setting this out is attached for consideration. It is not a statement of the law and is intended to operate as guidance. The Lord Chief Justice believes that this jurisdiction would benefit from a practice direction setting out guidance and information for those who may wish to seek leave to intervene as a third party and a draft is attached for consideration for those who might wish to express a view on this. It sets out the information which should be contained in an application to the court and provides information regarding decisions the court may make. 06 Jul 2009Summary Response on the Court Hearing Centre Consultation.A consultation paper "Proposals for Court Hearing Centres at Bangor, Larne, Limavady, Magherafelt and Strabane" was published on 12 January 2009. The period of consultation closed on 3 April 2009 and in total the Northern Ireland Court Service received 17 responses. 07 May 2009Proposal to increase the use of postal service for summonses in criminal proceedings in the Magistrates Court This paper seeks views on a proposal to increase the use of postal service for summonses in the magistrates courts. At present, summonses for offences dealt with in the magistrates courts are generally served personally by the Police Service of Northern Ireland (PSNI), although summonses for a range of less serious offences can be served by post. It is proposed that it should be possible for a summons to be served on a defendant by first class post for all criminal cases that are to be commenced by summons and which are prosecuted by the Public Prosecution Service for Northern Ireland (PPSNI), having been reported for prosecution by the police. PDF Download - Summonses Consultation document.pdf 190 KB
