BELFAST CIRCUIT

 

 

The Crown Court shall sit continuously at Laganside Courts, 45 Oxford Street, Belfast for taking pleas and conducting trials from Monday 5th September

2016 to Friday 1st September 2017 and thereafter at Laganside Courts as aforesaid and as required at the Royal Courts of Justice, Chichester Street, Belfast during sittings of the High Court, in accordance with such directions as may be given by the Lord Chief Justice and shall sit on such other days as the Lord Chief Justice may direct or approve.

 

Jurors in each panel for the Crown Court sitting for the County Court Division of Belfast shall commence service at Laganside Courts on the following

The Crown Court shall sit at the places listed in column 1 of the Schedule attached to these directions and dates for the commencement of trials at each place shall be the dates specified in column 2 save that a judge may direct a sitting of the Crown Court in any County Court Division on such other day as he may deem necessary for taking pleas and conducting trials.

Payments Into Court by a defendant under Order 21 of the County Court Rules (Northern Ireland) 1981 or, by a Respondent under Rule 4 of the County Court (Criminal Damage Compensation) Rules (Northern Ireland) 1983 or, under Rule 5 of the County Court (Criminal Injury to the Person) Rules (Northern Ireland) 1988 shall be made by lodging the desired sum with a copy of the lodgement documentation in Danske Bank, Donegall Square West, Belfast BT1 6JS. Cheques should be made payable to the Accountant General.

6. Undefended Divorce Petitions and all petitions relating thereto are processed at Coleraine Courthouse and shall be heard on such days and venues as the Chief Clerk shall fix.

7. Appeals from Magistrates court shall be listed as follows:-

a) 1st day of the Appeals For appeals against sentence only, appeals where the appellant is in custody, and urgent appeals;

b) 2nd day of the Appeals For appeals against conviction and sentence; and c) 3rd day of the Appeals For domestic and youth appeals.

The following matters shall be listed at the discretion of the Chief Clerk at 10.00am on such days and at such venues which are suitable to the

Court:

Divorce Petitions, Interlocutory Applications, Minors Petitions, Minors Payments Out of Court and any other such miscellaneous applications to the Court.

NOTES:

 

1. Crown Court arraignments may commence week commencing Monday 15th August 2016 and shall be listed on such days and at such venues as the Crown Court Judge and Chief Clerk may fix.

2. The District Judges Civil Bill Review Callover shall be listed on such days as the Chief Clerk shall fix.

3. Crown Court trials may be heard at Omagh, Enniskillen, or Dungannon at the direction of the Crown Court Judge.

4. Small Claim hearings by the District Judge at Omagh, Strabane, Enniskillen and Dungannon will be heard at 10:30am on such days as the Chief Clerk shall fix. Small Claims are processed at Enniskillen Courthouse.

5. Criminal Injury/Criminal Damage Appeals for the Division of Fermanagh & Tyrone will be heard at Omagh courthouse on Fri 9 Sept 2016, Tue 8 Nov 16, Thu 12 Jan 2017, Fri 28 April Criminal Damage/Injury Appeals are processed at Omagh Courthouse.

6. Undefended Divorce Petitions and all applications relating thereto are processed at Dungannon Courthouse and shall be heard on such days as the Chief Clerk shall fix.

7. The Judge may appoint other days for Adoption hearings.

 

Payments Into Court by a defendant under Order 21 of the County Court Rules (Northern Ireland) 1981 or, by a Respondent under Rule 4 of the County Court (Criminal Damage Compensation) Rules (Northern Ireland) 1983 or, under Rule 5 of the County Court (Criminal Injury to the Person) Rules (Northern Ireland) 1988 shall be made by lodging the desired sum with three copies of the lodgement documentation in the Bank of Ireland, 54 Donegall Place, Belfast, either to the credit of the Civil Bill Account or the Criminal Injuries Account as the case may be.

 

* This sitting is only for Appeals, from any Petty Sessions District within the County Court Division, where the appellant is in custody or where the appeal is urgent.
